1. Acceptance of Terms

Welcome to DIAMONDSOFM LLC ("Company," "we," "us," or "our"). By accessing and using our website, engaging our digital marketing services, or entering into a service agreement with us, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms").

These Terms constitute a legally binding agreement between you ("Client") and DIAMONDSOFM LLC. If you do not agree with any part of these Terms, you must not use our website or engage our services. We reserve the right to refuse service to anyone for any reason at any time.

By continuing to browse our website, submitting an inquiry, or signing a service agreement, you represent that you are at least 18 years of age, have the legal capacity to enter into this binding agreement, and are authorized to act on behalf of the business or entity you represent.

2. Services and Pricing

DIAMONDSOFM LLC is a full-service digital marketing agency specializing in brand strategy, social media management, search engine optimization (SEO), pay-per-click advertising (PPC), content marketing, email marketing, web design and development, analytics and reporting, and other related digital marketing services.

Service Packages

We offer a range of service packages tailored to meet the diverse needs of our clients, including but not limited to:

Pricing

Pricing: All prices for our services are quoted in United States Dollars (USD) and are subject to change with appropriate notice. Service fees are typically structured as monthly retainers, project-based fees, or performance-based arrangements, depending on the scope of work agreed upon. We strive to ensure pricing transparency; however, additional costs may arise for services outside the original scope of work, which will be communicated and approved by the Client before being incurred.

Pricing does not include third-party costs such as advertising spend, stock photography licensing, premium software subscriptions, or domain and hosting fees unless explicitly stated in the service agreement.

3. Service Agreement Process

Engaging DIAMONDSOFM LLC for digital marketing services involves a structured onboarding process designed to ensure alignment between our team and your business goals. The process typically includes the following steps:

All service engagements are subject to a signed service agreement. We reserve the right to decline any engagement for any reason, including but not limited to:

Custom Packages: For custom marketing engagements, additional terms may apply. Custom packages require a detailed strategy consultation, scope approval, and may require a non-refundable setup fee. Timelines for custom campaigns will be communicated during the proposal phase and depend on the complexity of the project.

4. Payment Methods

We accept the following payment methods for your convenience:

Monthly retainers are billed at the beginning of each service period. Payment is due upon receipt of invoice unless otherwise specified in the service agreement. By providing payment information, you represent and warrant that you are authorized to use the payment method and that all information provided is accurate and current.

We utilize industry-standard encryption and security measures to protect your payment information. However, you acknowledge that no electronic transmission is completely secure, and we cannot guarantee the absolute security of your data.

For project-based engagements and high-value contracts exceeding $10,000, we may require a deposit of up to 50% of the total project cost before work begins. The remaining balance will be invoiced according to the payment schedule outlined in the service agreement. Late payments may be subject to a late fee of 1.5% per month on the outstanding balance.

5. Service Delivery

DIAMONDSOFM LLC is committed to delivering high-quality digital marketing services in a timely and professional manner. Service delivery timelines and processes are outlined below.

Campaign Launch Timelines

Following the execution of a service agreement and completion of the onboarding process, initial campaign setup and launch typically occurs within 5-10 business days, depending on the complexity of the services engaged. More complex projects, such as website redesigns or comprehensive multi-channel campaigns, may require 2-6 weeks for initial launch. All timelines will be clearly communicated in the service agreement and during the onboarding process.

Reporting Schedules

Clients receive regular performance reports as part of their service package. Reporting frequency is determined by the service tier:

Deliverables

All deliverables, including creative assets, campaign strategies, analytics reports, and other materials, will be provided in formats agreed upon in the service agreement. We strive to meet all deadlines; however, timely delivery depends on the Client providing required information, feedback, and approvals within the agreed-upon timeframes. Delays caused by the Client may result in adjusted delivery schedules.

For urgent requests or expedited services, additional fees may apply. Please contact your account manager to discuss rush delivery options and associated costs.

6. Service Modifications and Cancellation

We understand that business needs evolve, and we strive to accommodate changes to your marketing strategy and service scope whenever possible.

Service Modifications

Clients may request modifications to their service package or scope of work at any time. Modification requests should be submitted in writing to your account manager. Changes to scope may affect pricing and timelines, and any adjustments will be documented in an amended service agreement or change order signed by both parties.

Cancellation Policy

Either party may terminate the service agreement by providing 30 days written notice prior to the desired cancellation date. Upon receipt of a cancellation notice:

Early Termination

For contracts with a minimum term (e.g., 3-month, 6-month, or 12-month agreements), early termination may be subject to an early termination fee as specified in the service agreement. This fee compensates the Company for resources allocated and opportunity costs associated with the engagement. We encourage clients to carefully review contract terms before signing.

7. Service Guarantees

8. Service Descriptions and Accuracy

We make every effort to accurately describe our services, capabilities, and expected outcomes on our website and in our proposals. However, we do not warrant that service descriptions, case studies, testimonials, or other content are guarantees of specific results for your business.

Marketing results are inherently variable and are not guaranteed. Past performance, case studies, and testimonials presented on our website or in marketing materials reflect the results achieved for specific clients under specific circumstances and should not be interpreted as a promise or guarantee of similar results for your business. Factors such as industry, competition, budget, market conditions, and the Client's own actions can significantly influence marketing outcomes.

Any projections, estimates, or forecasts provided by DIAMONDSOFM LLC are based on our professional experience and available data at the time of presentation. These projections are provided in good faith but are not binding commitments. Actual results may vary significantly from projections.
